Terms of Use

These terms apply to your use of Spark. Please read them carefully.
In short: Spark is for adults (18+). Everyone you talk to in Spark is a fictional AI character, not a real person. AI replies can be wrong, odd or inappropriate, so use your own judgement.
1. Acceptance of these terms
Spark is operated by Nandita Varshney, an independent developer (“Spark”, “we”, “us”). By creating an account or using Spark, you agree to these Terms of Use and to our Privacy Policy. If you do not agree, do not use Spark.
2. Eligibility
Spark is for adults aged 18 and older. By using Spark, you confirm that you are at least 18. Spark does not currently verify users’ ages. If we become aware that someone under 18 has registered for or is using Spark, we will remove their account.
3. What Spark is
Spark is an app for practising conversations. You chat with fictional characters, see an indication of how the conversation is going, and can ask for suggestions on what to say next. Spark is a practice tool for entertainment and self-improvement. It is not a dating service, and it is not professional, psychological or relationship advice.
4. AI and fictional characters
Spark includes fictional AI characters designed to simulate conversational practice. Their responses are generated by AI and do not represent statements from real people.
- The characters, including Riya, are fictional. You are not talking to a real person.
- A character’s reactions, and any indication of how interested a character seems, are generated by the app for practice purposes. They are not an assessment of you, and they are not a reliable prediction of how a real person would react.
- AI does not reliably understand emotions or intentions. Replies and suggestions may be inaccurate, inappropriate, offensive or unexpected.
5. Acceptable use
Use Spark respectfully and lawfully. You are responsible for the messages you send.
6. Prohibited behaviour
You must not:
- use Spark if you are under 18, or on behalf of someone under 18;
- use Spark to create sexual content involving minors, or content that sexualises anyone who appears to be a minor;
- use Spark to plan or promote violence, harassment, hate, self-harm or illegal activity;
- enter other people’s personal information, such as their names, contact details or private information, without their permission;
- try to make the AI produce harmful content, or to bypass Spark’s safety measures;
- interfere with, disrupt, overload, reverse engineer or gain unauthorised access to Spark or its systems;
- use automated means to access Spark or to extract its content;
- present AI-generated content from Spark as statements made by a real person.
7. Limitations of AI-generated content
AI-generated replies and suggestions are provided “as is”. We do not guarantee that they are accurate, complete, appropriate or suitable for any purpose. Do not rely on them for decisions about your health, safety, relationships, finances or legal matters.
8. Your responsibility
You decide how to use anything you learn or practise in Spark. Real people are individuals, and conversations with them will differ from practice conversations. Always respect other people’s boundaries and consent.
9. Your account
You sign in with your Google account. You are responsible for keeping access to your Google account secure and for activity on your Spark account. Tell us at sparkdeveloper040@gmail.com if you believe your account has been used without your permission.
10. Intellectual property
Spark, including its characters, design, text and software, belongs to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use Spark for your own non-commercial use, in line with these terms.
You keep any rights you have in the messages you send. You allow us to store and process them to provide and improve Spark, as described in our Privacy Policy.
11. Third-party services
Spark relies on third-party services, including Google Sign-In, Supabase, OpenAI and PostHog. Your use of Google Sign-In is also subject to Google’s terms. We are not responsible for third-party services that we do not control.
12. Suspension and termination
You can stop using Spark at any time and ask us to delete your account. Deletion requests are handled manually, within 30 days of receiving a valid request (see Delete your account). We may suspend or end your access if you break these terms, if required by law, or if we need to protect Spark, our users or others. We may change or stop offering Spark, or any part of it.
13. Disclaimers
To the extent permitted by law, Spark is provided “as is” and “as available”, without warranties of any kind, whether express or implied. We do not promise that Spark will be uninterrupted, error-free or always available.
14. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of Spark or from AI-generated content. Nothing in these terms limits liability that cannot be limited under applicable law.
15. Changes to these terms
We may update these terms. When we do, we will change the “Last updated” date above, and, for significant changes, let you know in the app or by other appropriate means. If you continue to use Spark after the changes take effect, you accept the updated terms.
16. Governing law
These Terms are governed by the laws of India.
